1. Introduction
This Privacy Policy explains how Kinetech Cloud, LLC, a Texas limited liability company ("Kinetech," "we," "us," or "our"), collects, uses, shares, and protects personal information in connection with the MACH website at machmanufacturing.io (the "Site") and the related marketing and sales interactions we have with you.
It applies to visitors to the Site, people who contact us or request a diagnostic, and prospective customers who engage with our sales and marketing. It is written for the people we interact with as a business — not as a description of internal operations.
What this policy does not cover. The data that flows through the MACH platform itself (production data, machine and sensor data, schedules, and other information a subscribing customer submits to or generates through the Service) is Customer Data, handled under the terms of the MACH Subscription & End User License Agreement and the customer's order, not this policy. This policy governs the Site and our sales and marketing activities. Kinetech does not sell your data.
2. Information We Collect
Information you provide to us.
When you fill out a form, request a diagnostic, subscribe to updates, or otherwise contact us, you may give us:
- identifying and contact details such as your name, business email address, phone number, job title, and company;
- the content of your message, inquiry, or diagnostic request, including any details you choose to share about your operations or requirements; and
- any other information you choose to provide in your communications with us.
Information collected automatically.
When you visit the Site, we and our service providers automatically collect certain technical information, including your IP address, device and browser type, operating system, referring and exit pages, pages viewed and links clicked, and the dates and times of your visits. We collect this information through cookies and similar technologies, as described in Section 4.
Information from third parties.
We use a website-visitor identification service (Swan) that may associate Site activity with business contact and firmographic information (such as a name, business email, company, or role) to help us understand which organizations are engaging with us and to support our marketing and sales outreach. We may also receive or supplement information about you and your company from analytics, advertising, and business-data providers. We combine this with the information described above.
3. How We Use Your Information
We use the information we collect to:
- respond to your inquiries, schedule and conduct diagnostics, and communicate with you about MACH;
- send marketing communications, updates, and content where permitted, and tailor that outreach to your interests and role;
- operate, maintain, analyze, and improve the Site and our marketing;
- understand which organizations engage with us and prioritize our sales follow-up;
- protect the security and integrity of the Site, prevent fraud and abuse, and enforce our terms; and
- comply with our legal obligations and exercise or defend legal claims.
Where required by law, we rely on your consent, our legitimate business interests, or another lawful basis to process your information for these purposes.
4. Cookies & Tracking Technologies
We use cookies, web beacons, and similar technologies to operate the Site, remember your preferences, measure performance, and support our marketing. These include:
- HubSpot, our customer relationship management, forms, and marketing platform, which sets cookies to recognize returning visitors, attribute form submissions, and measure the performance of our campaigns;
- Google Analytics (GA4), which helps us understand how visitors find and use the Site in aggregate; and
- Swan, a website-visitor identification service, as described in Section 2.
You can control cookies through your browser settings, including blocking or deleting them, though some features of the Site may not work as intended if you do. Many browsers and devices also support a Global Privacy Control (GPC) signal, which we honor where required as a request to opt out of certain sharing for advertising. For Google Analytics, you may use Google's opt-out browser add-on.
5. How We Share Information
We do not sell your personal information. We share it only as described here:
- Service providers. We share information with vendors that perform services on our behalf, including HubSpot (CRM and marketing), Google (analytics), and Swan (visitor identification), who are permitted to use it only to provide those services to us.
- Legal and protective disclosures. We may disclose information where required by law or legal process, or where we believe in good faith that disclosure is necessary to protect our rights, safety, property, or trade secrets, or those of others.
- Business transfers. If Kinetech is involved in a merger, acquisition, financing, reorganization, or sale of all or part of its assets, information may be transferred as part of that transaction, subject to this policy.
- With your direction. We share information when you ask us to, or otherwise with your consent.
6. Data Security
We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, disclosure, alteration, or loss. Information is encrypted in transit using TLS/SSL, and access to systems holding personal information is limited. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.
7. Data Retention
We keep personal information for as long as needed for the purposes described in this policy, including to maintain our business relationship with you, to send communications you have not opted out of, and to meet our legal, accounting, and reporting obligations. After that, we delete or de-identify it. Retention periods vary depending on the type of information and the reason we hold it.
8. Your Privacy Rights
Depending on where you live, you may have rights regarding your personal information. We honor these rights as applicable law requires.
U.S. state privacy rights (including California).
If you are a resident of California or another U.S. state with a comprehensive privacy law, you may have the right to:
- know and access the personal information we have collected about you, and how we use and share it;
- request correction of inaccurate personal information;
- request deletion of your personal information;
- opt out of the "sale" or "sharing" of personal information and of targeted advertising; and
- not receive discriminatory treatment for exercising your rights.
We do not sell personal information for money. To the extent our use of advertising and analytics cookies is considered "sharing" or "targeted advertising" under applicable law, you can opt out using your browser controls or a Global Privacy Control signal as described in Section 4.
EEA and UK rights.
If you are in the European Economic Area or the United Kingdom, you may have the right to access, correct, delete, restrict, or object to our processing of your personal information, to data portability, and to withdraw consent where we rely on it. You also have the right to lodge a complaint with your local supervisory authority.
How to exercise your rights.
To make a request, email us at privacy@machmanufacturing.io. We will verify your request as required and respond within the time frame the applicable law allows. You may use an authorized agent where the law permits.
9. Children's Privacy
The Site is intended for businesses and is not directed to children. We do not knowingly collect personal information from anyone under 16. If you believe a child has provided us personal information, please contact us and we will take appropriate steps to delete it.
10. International Visitors
Kinetech is based in the United States, and we operate the Site and process information here. If you access the Site from outside the United States, you understand that your information may be transferred to, stored, and processed in the United States, where data-protection laws may differ from those in your jurisdiction.
11. Third-Party Links
The Site may link to third-party websites and services that we do not control. This policy does not apply to those sites, and we are not responsible for their content or privacy practices. We encourage you to review the privacy policies of any site you visit.
12. Changes to This Policy
We may update this Privacy Policy from time to time. When we make material changes, we will revise the "Last updated" date above and, where appropriate, provide additional notice on the Site. Your continued use of the Site after an update takes effect constitutes acceptance of the revised policy.
